1. Scope
These Terms of Service ("Terms") apply to the use of the website and web application Plan2Fund and all digital services offered through it, including the creation, editing, review and export of business plans, financial plans, funding application documents and similar documents.
Plan2Fund is intended for both consumers ("B2C") and businesses ("B2B"), including founders, companies and advisors/consultants.
Any deviating terms of users shall only apply if expressly accepted by us in writing.

3. Definitions
Users means all persons using Plan2Fund.
Consumers means natural persons acting for purposes that are predominantly outside their trade, business or profession.
Businesses means persons or entities using Plan2Fund for business or professional purposes.
Advisors means users who use Plan2Fund to manage their own clients or mandates.
Credits means digital usage units that may unlock certain functions, including AI features, document exports or checks.
Subscription means a recurring paid access to Advisor features.
Digital services include digital content and digital services provided through Plan2Fund.
4. Conclusion of Contract
The presentation of Plan2Fund on the website does not constitute a legally binding offer, but an invitation to use or order the service.
A contract is concluded when users create an account, purchase credits, subscribe to a paid plan or use a paid function and we confirm or enable access.
For paid services, the price, scope, term and payment conditions are shown before the order is completed.
5. Scope of Services
Plan2Fund provides digital functions for creating, editing and managing documents, including:

Plan2Fund does not guarantee successful funding approval, bank financing, investment, tax optimization or legal compliance.
6. Credits
Users may purchase credits. Credits can be used for certain digital functions, including AI usage, document exports or checks.
Credits are allocated to the user account after successful payment, unless stated otherwise.
Credits cannot be exchanged for cash and cannot be transferred to other accounts unless we expressly agree.
Unused credits may expire after a specified period from the purchase date if clearly stated at the time of purchase and if mandatory legal rights do not prevent this.
We may change the number of credits required for individual functions. Credits already purchased remain digital usage units; however, future function prices may change.
7. Advisor Subscriptions
Advisors may purchase paid subscriptions. The scope of services depends on the selected plan.
Subscriptions may be billed monthly or annually. If clearly stated in the order process and accepted by the user, subscriptions renew automatically for the respective term until cancelled.
Subscriptions may be cancelled at any time with effect at the end of the current billing period, unless a different minimum term has been agreed.
Amounts paid for an ongoing billing period are generally not refunded on a pro rata basis, to the extent permitted by law.
We may suspend or terminate a subscription if payments fail, the service is misused or security risks arise.
8. Prices, Payment and Invoices
All prices are shown during the order process. Prices for consumers include statutory VAT where applicable. Prices for businesses may be shown excluding VAT if clearly indicated.
Payments are processed through external payment providers, in particular Stripe. Additional payment provider terms may apply.
Paid functions are generally enabled only after successful payment.
Invoices are provided electronically or by email.
9. Consumer Withdrawal Right
Consumers generally have a statutory 14-day withdrawal right for distance contracts, unless a legal exception applies.
For digital content or digital services, the withdrawal right may cease under certain conditions, in particular where consumers expressly agree that we begin performance before expiry of the withdrawal period and acknowledge that they thereby lose their withdrawal right, to the extent permitted by law.
Before the purchase or use of paid digital services, we may therefore request a separate confirmation, for example:
"I expressly agree that Plan2Fund begins performing the digital service before the expiry of the statutory withdrawal period. I acknowledge that I thereby lose my withdrawal right, provided that the legal requirements are met."
If the withdrawal right is not validly excluded, consumers retain their statutory rights.
You can submit a withdrawal request using our withdrawal form.
This provision does not apply to Advisors (users who use Plan2Fund to manage their own clients or mandates).
10. AI Features and Professional Limitations
Plan2Fund uses AI-assisted features to support document creation, editing and review.
Plan2Fund provides digital software functions, templates, AI-assisted text suggestions and structured guidance. Plan2Fund does not provide individual legal, tax, financial, funding or investment advice and does not replace review by appropriately qualified professionals.
AI-generated content may be incomplete, inaccurate, outdated, misleading or unsuitable from a legal or business perspective. Users are responsible for reviewing all AI-generated content before using, submitting or publishing it.
In particular, we do not guarantee:
Users use the results at their own responsibility.
11. User Responsibilities
Users must use Plan2Fund only lawfully and in accordance with these Terms.
Users must not:
Advisors are responsible for ensuring that they are authorized to enter, process and use client data and that their clients are properly informed.
Users who enter personal data of third parties, in particular clients, mandatees or employees, into Plan2Fund warrant that they are authorized to do so and have informed the data subjects accordingly. For business customers who use Plan2Fund as a data processor, Plan2Fund provides a data processing agreement pursuant to Art. 28 GDPR. An agreement may be requested at hello@plan2fund.io.
12. User Account and Security
Certain functions require a user account.
Users must provide accurate and up-to-date registration information and keep login credentials confidential.
Users must notify us without undue delay if they suspect unauthorized use of their account or a security risk.
We may temporarily suspend or permanently terminate accounts if there is a reasonable suspicion of abuse, security risks, legal violations, non-payment or breach of these Terms.
13. Content Rights and Intellectual Property
Users retain the rights to their input content, project information and document data.
Users grant us the rights necessary to provide Plan2Fund, technically process content, generate documents, enable exports and perform AI functions.
All rights to the platform, software, user interface, templates, designs, workflows, trademarks, databases and other Plan2Fund content remain with us or our licensors.
Exported documents may be used by users for their own purposes, provided that no third-party rights are infringed and no different terms apply.
14. Availability and Changes
We strive to provide reliable availability of Plan2Fund. However, uninterrupted or error-free availability is not guaranteed.
Maintenance, updates, security measures, outages or external service providers may temporarily restrict use.
We may further develop Plan2Fund and modify, add or remove features, provided this is reasonable for users and does not materially impair essential contractual obligations.
15. Data Protection
Information on the processing of personal data is provided in our Privacy Policy.
Users must comply with applicable data protection laws when using Plan2Fund.
If Advisors process personal data of their clients or mandates in Plan2Fund, a separate data processing agreement pursuant to Art. 28 GDPR may be required. The DPA is available at https://plan2fund.io/legal/dpa.
16. Liability
We are liable in accordance with statutory law for damages arising from injury to life, body or health and for damages caused intentionally or by gross negligence.
In cases of slight negligence, we are liable towards businesses only for breaches of essential contractual obligations and only for foreseeable, typical damages, to the extent permitted by law.
Mandatory consumer rights remain unaffected.
To the extent permitted by law, we are not liable for indirect damages, loss of profits, rejected funding applications, financing refusals, investment losses, data loss, reputational damage or damages resulting from unchecked use of AI-generated content.
Users are responsible for regularly saving, reviewing and timely submitting their documents.
17. Term and Termination
Free user accounts may be deleted or terminated by users at any time, unless outstanding payments, statutory retention obligations or legitimate interests prevent this.
Paid services end when credits are consumed, the booked term expires or the subscription is cancelled.
We may terminate contracts for good cause, in particular in cases of abuse, legal violations, security risks or payment default.
After account termination, data may be deleted in accordance with the Privacy Policy.
18. Changes to these Terms
We may amend these Terms if this is required due to technical, economic or legal changes.
We will inform users of material changes in an appropriate manner. Where legally required, we will obtain consent.
If users do not agree to amended Terms, continued use of certain paid services may be restricted or terminated.
19. Governing Law and Jurisdiction
Austrian law applies, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law applies only to the extent that it does not deprive them of mandatory consumer protection rights of their country of habitual residence.
For businesses, the exclusive place of jurisdiction, to the extent permitted by law, is the competent court in Vienna.
20. Final Provisions
If any provision of these Terms is or becomes invalid, the validity of the remaining provisions remains unaffected. The statutory provision shall apply in place of the invalid provision.
The contract language is German. An English version may be provided. In case of doubt, the German version prevails.
